SEC Drops Civil Fraud Case Against SolarWinds

Specifically, the SEC claimed that SolarWinds did not inform investors about vulnerabilities before a significant supply-chain attack by Russian hackers infiltrated the company’s software.

Initially, the SEC framed its lawsuit around claims of fraud and internal control failures. However, in 2024, a federal judge undermined the case significantly by dismissing most of the allegations, particularly those raised after the 2020 disclosure of the attack. Eventually, both the SEC and the defendants agreed to dismiss the case with prejudice, meaning it cannot be refiled. This decision does not impact other ongoing investigations, according to the SEC.

SolarWinds expressed relief at the resolution, labeling the SEC’s case an overreach. The outcome not only vindicates the company’s actions but also addresses concerns from cybersecurity leaders about legal repercussions affecting their ability to operate.
